Privacy Policy

This policy sets out the basis on which your personal data will be collected, held and processed by BIA Systems EOOD.

We are committed to protecting your personal information and your right to privacy.

Should we for any reason elect to change this Privacy Policy, the changes will be posted here in a timely manner so that you are always informed about how we collect and use information, and when we may disclose it to others.

This Privacy Policy applies to personal data we collect from users of BIA platform services.

Users are subscribers to BIA's SaaS automation platform.

BIA services refer to BIA's SaaS automation platform tools and consultancy services.

Personal data means any information relating to an identified or identifiable natural person.

For the avoidance of doubt, this Privacy Policy does not apply to personal data relating to our business customers' end users, consumers, or customers, which we process separately in our capacity as a service provider or processor under our agreements with those business customers.

Information collection:

We process personal data relating to users of the BIA Platform, including account administrators and other authorized users of our business customers, where we have a valid legal basis to do so under applicable law. Depending on the circumstances, this may include processing that is necessary for the performance of a contract, compliance with legal obligations, our legitimate interests in operating, securing and improving the BIA Platform, or consent where consent is required by applicable law.

We collect personal data about platform users when they provide information directly to us or when it is automatically collected in connection with their use of our Services.

Data Retention:

We retain personal data relating to users of the BIA Platform only for as long as necessary for the purposes described in this Privacy Policy, including to provide and secure the BIA Platform, manage user accounts and access, respond to requests, comply with legal and regulatory obligations, maintain appropriate business and audit records, enforce our agreements, and resolve disputes.

Retention periods may vary depending on the type of data and the purpose for which it is processed. In some cases, we may retain certain information for longer where required or permitted by applicable law, or where necessary for legal, accounting, tax, compliance, security, fraud prevention, audit, or record-keeping purposes.

When we no longer have a legitimate business need or legal basis to retain personal data, we will delete, anonymize, or securely dispose of it. If immediate deletion is not possible, including where data is stored in backup archives, we will securely store the data and isolate it from any further active processing until deletion becomes possible.

For the avoidance of doubt, this Privacy Policy applies to personal data relating to users of the BIA Platform and does not govern retention of personal data processed by BIA on behalf of its business customers in its role as a service provider or processor, which is governed by the applicable customer agreement and any related data processing terms.

Users’ rights

Users have the following data protection rights:

  • to be provided with any information and communication related to the processing of their data in a concise, transparent, intelligible and easily accessible form, using clear and plain language;

  • to be informed about the exact scope of the personal data collected with respect to them; as well as to be provided with contact details of the controller of that data; the contact details of data protection officer, where applicable; purposes of the processing of the collected personal data, as well as the legal basis for the processing; recipients and categories of recipients of the personal data, if any;

  • to access the personal data concerning them;

  • to correct and update the personal data concerning them;

  • to request rectification of inaccurate personal data concerning them;

  • to request deletion of the personal data concerning them; 

  • to request restriction of the personal data concerning them;  

  • to object to processing of the personal data concerning them.

 

Users may update or change the personal information they have provided to us by logging into the Bia platform. 

 

We provide appropriate methods for facilitating the exercise of your data protection rights.  In case you have any questions or request with respect to the exercise of your rights you can contact us on legal@bia-systems.tech. We respond to all inquiries and requests we receive from individuals willing to exercise their data protection rights in accordance with applicable data protection law. We may ask you to verify your identity in order to help us respond efficiently to your request.

Legal Basis for Processing

  • Consent: We may process your data if users have given us specific consent to use their personal information in a specific purpose.  

  • Legitimate Interests: We may process user’s data when it is reasonably necessary to achieve our legitimate business interests.  

  • Performance of a Contract: Where we have entered into a contract with client, we may process their personal information to fulfil the terms of our contract.  

  • Legal Obligations: We may disclose user’s information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).  

 

We only share and disclose users' information with the following third parties and service providers where relevant to the provision and security of our services:

Website hosting and cloud infrastructure: Microsoft Azure Cloud Services.

Data protection

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, users should only access the Bia services within a secure environment and is responsible for the selection and use of any privacy settings or security capabilities within Third-Party Applications.
